Compensation for Slips and Falls under Ontario’s Occupiers’ Liability Act
If you or a family member trip or slip and fall resulting in an injury, compensation for those injuries may be available under Ontario’s Occupiers’ Liability Act. The Occupiers’ Liability Act provides that anyone who is in physical possession of a property or has responsibility for and control over a property (the “occupier”) owes a duty of care to take reasonable precautions to ensure that all persons are reasonably safe while on their property.
Who is Responsible for Preventing Slips and Falls?
This duty of care applies to commercial businesses, homeowners, landlords, tenants, and schools, among others. In some cases, you may start a lawsuit against the owner and/or tenant of a property and/or the company responsible for maintaining the area where you fell. Determining legal responsibility or fault for such injuries is not always straightforward. As a result, following any serious fall, you should identify any witnesses, take photographs of the location, report the fall to the property owner and obtain legal assistance.
Notice Requirement for Slip and Fall Injuries in Ontario
In Ontario, depending on where the fall occurred, you may be required to notify the property owner (or negligent party) of your injury and intent to commence a legal proceeding against them. For example, if your injury is a result of a slip and fall incident on ice or snow, you must provide notice to the occupiers of the area within 60 days of the incident. If your injury occurred at a municipal property or on a roadway, such as a city sidewalk, you have 10 days from the date of the injury to provide notice. For these claims, it is important you speak to an experienced personal injury lawyer as soon as possible.
Slip and Fall Injury Claims
If you suffered injuries as a result of someone else’s negligence, you may be able to recover compensation for your pain and suffering, income loss, medical and rehabilitation expenses, care costs, and loss of housekeeping and home maintenance services. The amount of compensation you may receive will depend on how serious your injury is and how it affects your life.
